Terms of Service

These terms are the agreement between you and Retrohale. They are written in plain English on purpose. Please read them.


1. What Retrohale is

Retrohale is a free cigar journal and virtual humidor. It lets you log the cigars you smoke, keep track of what is in your humidors, and see patterns in your own preferences over time.

Retrohale is operated by Mark, an individual based in Kentucky, United States. It is a personal project, not a company.

Retrohale does not sell, ship, distribute, or deliver tobacco products of any kind. It is a record-keeping tool. Where the app links out to retailers, those are separate businesses and any purchase is between you and them.


2. You must be 21 or older

You must be at least 21 years old to use Retrohale. By creating an account, you confirm that you are 21 or older.

If you are under 21, you may not use the app. Accounts found to belong to anyone under 21 will be terminated and the data deleted.


3. Your account

You are responsible for your account and for keeping your password secure. Do not share your account with anyone. If you believe someone else has accessed your account, contact us at the address in Section 14.

You must provide accurate information when signing up. One account per person.


4. Your content is yours

You own everything you put into Retrohale — your notes, your ratings, your photos, your inventory, all of it. It is your journal.

By using the app, you grant Retrohale only the limited permission needed to actually run the service: to store your content, process it, and display it back to you. That is the entire scope of it. Your content is not used for advertising, not sold, not shared publicly, and not used for any purpose other than providing the app to you.

You can export all of your data or permanently delete your account at any time, from within the app.


5. What you agree not to do

Keep it simple — do not:

Accounts that violate these terms may be suspended or terminated.


6. The app is free

Retrohale is free to use. There is no subscription, no paywall, and no advertising.

Hosting costs are covered by affiliate links. Some links in the app — particularly in the Gear section and in cigar price listings — go to outside retailers. If you click one and make a purchase, Retrohale may earn a small commission at no additional cost to you.

As an Amazon Associate, Retrohale earns from qualifying purchases.

This is disclosed openly because you deserve to know why a link is there. Retrohale is not paid to feature specific products in "Mark's Picks" — those are personal recommendations. Category and search links are simply a doorway to shop, not endorsements.


7. Prices and product information

Cigar prices shown in the app come from retailer data feeds and are updated periodically, not in real time. A price shown in Retrohale may differ from the price at the retailer.

Always confirm the actual price on the retailer's own site before buying. Retrohale makes no guarantee as to the accuracy, availability, or current price of any product.

Cigar catalog information (brands, wrappers, sizes, origins) is provided for reference and may contain errors.


8. Purchases happen elsewhere

Retrohale does not process payments and does not sell anything. When you tap a buy link, you leave Retrohale and go to a third-party retailer's website. Anything that happens there — the purchase, payment, shipping, age verification, returns, customer service — is between you and that retailer, and is governed by their terms and their privacy policy.

Retrohale is not responsible for third-party retailers, their products, their practices, or their websites.


9. No warranty

Retrohale is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Plainly: this is a free app built by one guy in his spare time. It is built with care, but it may have bugs, it may go down, and features may change. No guarantee is made that it will be uninterrupted, error-free, or that data will never be lost.

Please export your data periodically if it matters to you. The export feature exists for exactly this reason.


10. Limitation of liability

To the fullest extent permitted by law, Retrohale and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of the app.

To the fullest extent permitted by law, total liability for any claim relating to the app will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.


11. Health and legal notice about tobacco

Cigars are a tobacco product. Smoking is harmful to your health. Retrohale does not encourage anyone to start smoking, does not promote consumption, and makes no health claims of any kind. It is a journal for adults who already choose to smoke.

You are responsible for complying with the laws of your own state and locality regarding tobacco.


12. Ending your use

You can stop using Retrohale at any time and delete your account from within the app. Deletion is real and permanent.

We may suspend or terminate an account that violates these terms, or discontinue the app entirely. If the app were ever shut down, reasonable advance notice would be given so that you could export your data first.


13. Changes to these terms

These terms may be updated from time to time. The "Last updated" date at the top will change, and material changes will be communicated in the app. Continuing to use the app after a change means you accept the updated terms.


14. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law principles.

Any dispute arising out of these terms or your use of Retrohale will be brought exclusively in the state or federal courts located in the Commonwealth of Kentucky, and you consent to the jurisdiction of those courts.


15. Everything else

If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the entire agreement between you and Retrohale. Failing to enforce a provision does not waive it.
